Well, I've done my job as a friend and put up a few off topic things to get the ball rolling. This one is kind of bizarre. I don't know if I buy it, but I can see why the court ruled not guilty. I do think that the woman has a rock solid civil case, though. She was affected even if he didn't mean to do anything to her.

I'm just really not sure that anyone could start having sex with someone in their sleep. Fondling, yeah, but actually getting on for the ride? No way. So what do you guys think?




OSLO (Reuters) - A Norwegian court has acquitted a man accused of raping a sleeping woman after he said he was also asleep at the time.

   

The 18-year old woman, who had gone to sleep dressed in trousers and a sweater on a sofa after a party with friends, awoke to find the 34-year-old man having sex with her. The man said he was woken by her screams for help.


"He said that he was asleep and the majority of the judges found that they could not rule out the possibility," defense lawyer Christian Riig told NRK public radio on Thursday.


The three-judge panel in the court in Inderoy, west Norway, acquitted him by a 2-1 margin because of doubts about whether he had been conscious.


Riig declined to speculate about how the man, who had been drinking, could have had sex in his sleep, apparently after undressing the woman. But he said an ex-partner of the man had testified by telephone that similar things had happened to her.

I can see why they had to rule not guilty, but I don't buy it. This whole "reasonable doubt" thing has gone too far. "Oh, he may have been asleep" or "He may be experiencing temporary insanity." :roll:

He may have been asleep, but I think for me this depends on how much he was drinking.  If he'd had enough that he passed out, then imo he's responsible for what happens afterwards because he's set the table.  If he just fell asleep after having a whole one or two and that happened, then I think I'd find reasonable doubt, too.  This coming from someone who's removed two layers of sheets from a bed, taken them downstairs (with a pillow), made a bed on the couch (which includes tucking them under) and laid back down.
